EASTHAM BOARD OF HEALTH MEETING
THURSDAY- JANUARY 26, 2006 -3 P.M.

The Chairman opened the meeting at 3:p.m.
OPENING STATEMENTS
Jane Crowley updated the Board regarding the water testing program
for the Water Resource Advisory Board.
Jane updated the Board about an Emergency Dispensing Sites (EDS) education day held at Cape Cod Community College.
The Health Agent also informed the Board about the above ground tank education program which the Eastham Health and Fire Departments would present to the towns of Brewster and Yarmouth.
Jane also informed the Board that14 Americorp volunteers will help the rabies program and distribute bait units containing rabies vaccine. Racoons and other wildlife find the vaccine -containing bait, eat it and become protected against the rabies disease.
VARIANCE
1. McMakin 45 Deerfield Lane Map-12 Parcel-145
Emily Beebe and Dena McMakin presented the plan to upgrade the septic system. The variances requested are as follows:
Eastham Board of Health Regulations
Separation between street & well - 25'required - 5' provided
Separation between property line & well - 10' required - 7' provided
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. No increase in flow allowed.
2. Deed restriction to 3 bedrooms.
3. New well to be tested for VOC and Routine parameters.
4. Owner to install replacement well as shown on the plan.
5. Shadow and footprint to remain the same unless reviewed by Board of Health.
6. All covers within 6" of finished grade and new soic pipe if orangeburg from house to tank
Dr. James Taylor made the motion to approve the plan with the 6 conditions.
Joyce Gibson seconded the motion
THE VOTE WAS 4-0 FOR APPROVAL
Macaskill 10 Ellis St. Map-22 Parcel-18
(Goose Hummock Shop)
Bernard Young from Labarge Engineering submitted a plan requesting the use of a tight tank to eliminate all other environmental variances. The Board approved with these conditions:
No increase in design flow be allowed.
Requirement of existence of tight tank to be recorded on deed.
Town of Orleans approval required.
Subject to Conservation Commission approval.
24 hour dry test of tight tank to be conducted subject to inspection.
48 hours water test of tight tank to be conducted subject to inspection.
DEP approval required.
Dr.Taylor made the motion to approve the plans with the 7 conditions.
Pat Larriviere seconded the motion.

REVIEW
Trombetta 160 Alice Road Map-4 Parcel-356
Laura Scholfield present Title 5 plans for provisional approval with secondary treatment using Waterloo Biofilter UG-550N.
The Board approved the plans with these conditions:
1. Routine water and VOC quality test results be provided for
2. No increase in design flow be allowed
Secondary treatment and monitoring under provisional use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). After this time reduction of testing could be requested to BOH by owner. Operator to report results via Carmody Data Base if available or directly to the Eastham Health Department if not available.
Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system.
Deed restriction for 3 bedroom use and use of Waterloo Biofilter UG-55ON alternative technology requirement to be recorded on the deed.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
7. Any increase in habitable square footage would require Board of Health review.
8. Subject to Provisional use approval conditions by DEP and supplier certification.
Dr. Taylor made the motion to approve the plan with the eight conditions.
Pat Lariviere seconded the motion.

Watson / Scanlon 1315 Samoset Road Map-13 Parcel-116
Terry Ryder presented plans requesting a building permit to add a new foundation, dormer and add additional square footage to an existing dwelling . This property has a Title 5 system that was installed in 1990 with a set back variances that include reduction of distance to wet land and is determined to be environmentally sensitive lot. There is 4 ft.
separation of bottom of leach area to observed groundwater. The system has a capacity for 2 bedrooms. This proposed remodeled dwelling with a full dormer will have 2 bedrooms.
Since this is an environmentally sensitive lot the Board must review the project. The Board has often required secondary treatment in cases where additions have been added on environmentally sensitive areas.
Terry Ryder offered to inspect the current system and return to verify ground water at high tide cycle.
THE BOARD VOTED TO CONTINUE THIS REVIEW AT THE NEXT BOARD OF HEALTH MEETING FEBRUARY 23, 2006.
